Phelps Partner Alan Harrell Obtains Favorable Summary Judgment Ruling in Florida Toxic Tort Litigation
Baton Rouge Partner Alan Harrell recently obtained a summary judgment ruling in favor of a product manufacturer defendant in toxic tort litigation filed in West Palm Beach, Fla.
The plaintiff alleged that he developed Myelodysplastic Syndrome (MDS) from exposure to benzene as a potential contaminant in flooring adhesives. The trial court granted a motion for summary judgment on the issue of specific causation.
Alan delivered oral arguments to the trial court and a panel of Florida’s Fourth District Court of Appeal, which affirmed the trial court’s decision. The case is Robert J. O'Donnell and Sandra O'Donnell Vs W.F. Taylor Co., Inc., et al., case number 4D18-3772, in the Fourth District Court of Appeal of the State of Florida.
