Phelps Secures Appellate Victory for City and Local Law Enforcement in Case Involving Probable Cause
May 12, 2022 - Phelps secured a victory in the 5th U.S. Circuit Court of Appeals for a municipal client and two law enforcement officers. A three-judge panel including circuit judges Edith Jones, Leslie Southwick and Andrew Oldham affirmed a grant of summary judgment on claims brought under federal and state law, agreeing with Phelps' argument that probable cause is still warranted when a suspect asserts a claim of self-defense. The panel also upheld an award of fees and costs in favor of Phelps' client.
