Phelps Welcomes Partner Brian Kilmer to Help Clients with Bankruptcy Matters Throughout Texas and Louisiana
HOUSTON — Nov. 2, 2023 — Texas currently leads the nation in commercial bankruptcy filings for 2023, with major companies choosing to file in the state to resolve multimillion-dollar restructurings. Accomplished bankruptcy counsel Brian Kilmer brings 25 years of experience guiding creditors and debtors through reorganizations – with a focus on helping unsecured creditors’ committees and debtors – to Phelps’ Texas clients and completes Phelps’ full range of bankruptcy services.
Brian works closely with creditors' committees, business-bankruptcy debtors, and other estate officials to find practical paths through restructuring and Chapter 7 and Chapter 11 filings in multiple states, including Texas, Louisiana, Delaware, New York, Michigan and Florida. Whether in out-of-court workouts or courtroom bankruptcy proceedings, Brian is adept at preserving clients’ interests while managing negotiation and liquidation options.
Highly regarded in the local business community, Brian is often sought after to present his insights to debtors, newly formed creditors’ committees, and acquirers of distressed assets and special servicers of defaulted loans. And after the reorganization, Brian regularly represents post-confirmation trustees in bankruptcy litigation as well as represents defendants in those post-confirmation litigation matters. This comprehensive experience gives Brian an understanding of the full bankruptcy lifecycle, which will benefit Phelps and its clients as the firm expands its bankruptcy support for companies throughout the Gulf South.
“I am thrilled to be joining the Phelps team for a number of reasons,” Brian said. “I am excited to be part of a firm that has such a strong footprint throughout the South, and in Louisiana in particular. As a Tulane Law graduate, I have always been an admirer of the firm and I feel humbled and blessed to have the opportunity to be a partner at Phelps.”
“Businesses are looking to Texas’ bankruptcy venues to manage increasingly complex reorganizations,” said Ivan Rodriguez, managing partner of Phelps’ Houston office. “With a long, successful track record in the Texas bankruptcy market, Brian brings significant experience and a ‘boots on the ground’ approach to help local, regional and national clients. His skill as a trial lawyer and mediator will be an asset to clients navigating high-pressure, multiparty restructurings.”
