Anthony Gambino practices in the area of commercial litigation with an emphasis on construction disputes. He represents owners, engineers, general contractors, subcontractors and suppliers in disputes involving private and public construction projects across the country. Anthony’s construction practice includes drafting liens, filing lawsuits and demands for arbitration and representing construction clients in litigation and alternative dispute resolution.
Owners and contractors also rely on Anthony to manage the risks inherent in construction projects on the front end. He reviews and negotiates contracts to protect clients’ interests and safeguard against future disputes.
In addition to construction matters, Anthony has experience prosecuting and defending matters in various areas of law, including real estate and property disputes, breach of contract claims, toxic exposure cases and collection matters.
Anthony also serves on the firm's Technology Committee.
Experience
- Secured damages for general contractor as second chair in three-week arbitration in Washington, D.C., after owner’s attempted termination for cause, assessment of liquidated damages, and nonpayment of payment applications arising out of the construction of a methanol facility in West Virginia.
- Drafted, argued and won summary judgment for apartment complex owner, proving liability for construction defects against general contractor and resolving claims raised by contractor and architect in favor of the client in North Carolina state court.
- Resolved contract dispute for general contractor as second chair in multiweek arbitration to secure a time extension, avoid liquidated damages and receive extra compensation for force majeure events and change orders added during construction of South Louisiana manufacturing facility.
- Obtained partial summary judgment and trial win for a general contractor, defeating a terminated subcontractor’s claims of unpaid invoices and recovering damages for the subcontractor’s breach of contract in Louisiana state court.
- Achieved a favorable result for an earthwork subcontractor in a private arbitration against a general contractor and industrial facility owner involving wrongful termination and unpaid invoices under the Louisiana Private Works Act.
- Obtained multiple bench trial victories across Louisiana for a midstream pipeline company arising out of the construction of a $1 billion natural gas-gathering pipeline.
