Dan counsels clients through every step of commercial litigation on a wide range of claims, from construction disputes and professional liability claims to landlord-tenant issues. From the outset of the case, and sometimes even before a suit is filed, Dan can assess the nature of the dispute, the evidence, and all parties’ positions to come up with a litigation plan. He works closely with clients to understand their goals and tailor his plan to best achieve them.
Experience
- Achieved dismissal of fraud case seeking almost $3 million against pharmacist in U.S. District Court based on lack of personal jurisdiction, moving litigation to Texas and Washington D.C., which helped the client resolve the case more quickly and for less than one half of the demanded amount.
- Secured $700,000 judgment and dismissal of all counterclaims for structural steel erection contractor’s breach of contract claim after a five-day arbitration, helping client avoid a $1 million counterclaim and receive the remainder that it should have been paid for a public university football stadium construction project.
- Obtained dismissal through motion of whistleblower claims that former in-house counsel was discharged for alerting client to potential FLSA violations, ending the suit early and eliminating the need for lengthy litigation costs.
- Resolved professional malpractice claims against a group of Fire Protection Engineers through multi-party arbitration by obtaining expert opinions that claims related to military base hospital project were construction, not design, failures.
