Counseled client about coverage, monitored underlying cases and made recommendations regarding settlements of underlying cases. Defended client in cases in which insured disagreed with coverage determinations.
- Defended excess directors and officers (D&O) insurer in complex, longstanding multi-carrier coverage litigation arising from an underlying SEC settlement related to market timing in mutual funds. Achieved a satisfactory resolution of claim prior to trial.
- Provided advice to insurance carrier in connection with various claims arising out of underlying allegations of copyright infringement, trademark infringement, slander and libel. Counseled on coverage and made recommendations as to settlements.
- Defended excess insurance carrier in litigation seeking coverage for underlying settlement of a putative nationwide class action lawsuit alleging environmental damage from decades of use of herbicide produced by insured. Achieved a satisfactory resolution of claim prior to trial.
