Winston is committed to the industries he serves as well as his profession. He is a frequent speaker at architectural and engineering professional events. As an active member of the Mobile Bar Association’s mentoring committee he guides young lawyers to find best practices to become active members of the bar and community. Experience
- Represented insurer in breach of contract and bad faith action by homeowners. Obtained summary judgment on grounds that policy had been cancelled at time of occurrence and that insured had received notice of cancellation, despite denials of receipt by insured.
- Represented contractors and suppliers in numerous actions seeking payment, successfully obtaining full payment of numerous claims, through demand letters, litigation and the assertion of liens.
- Successfully obtained resolution of construction claim against design professional before suit was filed, orchestrating a multiparty settlement by negotiating contributions from parties and insurers.
- Obtained voluntary dismissal of claim against parts supplier in asbestos claim before significant discovery had commenced, through persuasive correspondence demonstrating lack of client's involvement.
- Negotiated and obtained successful resolution of claims for breach of noncompetition agreements, on behalf of both employers and employees.
